We have been informed by one of our esteemed members – M/s. S A Rawther Spices P. Ltd., G G Palya, Tumkur Road , Bangalore , India that, vide their Contract No. 33836, 33837, 33838 and 33839 they have shipped 100 MTs (4 x 40 ft Containers) of Black Pepper to the above named Buyer  in the U.S. with the terms of payment as CAD on first presentation.

The documents & bills relating to the shipment were sent to the Buyer on 13th March 2009 , however, till date the Buyer has not cleared the Shipment. The reasons for refusing clearance of the bills as given by the Buyer is “ Late arrival of goods”. The usual transit period for goods sent to America is 30-35 days and the goods reached New York well within this period. Furthermore, no specified delivery schedule  was mentioned in the contract. When followed up, the Buyer is asking for reduction in Price, which is unfair and unethical business practice with a purposeful  intention to default in payment and contractual obligation.  The Agents in this transaction is – M/s. Global Ingredients Sourcing Inc., also backed out in helping out to resolve the payment issue of our member. The value involved in this transaction is US Dollars 74,406.60 x 4 invoices i.e. USD 2,97,626.40. Copies of the transaction/correspondence have been presented by M/s. S A Rawther Spices to your Association as evidence.

In the light of the above stated facts, all members are hereby warned and alerted to avoid contracting/dealing in any manner with M/s. Gel Spice Co as also their Agents M/s. Global Ingredients Sourcing Inc.
